Why the State Wants to Talk to You

- Your employee handbook or written company policy if misconduct is alleged

- "Are you currently working, including part-time or self-employment?"

- "Are you able and available to work full time?"

- "What jobs have you applied for in the last few weeks?"

Answer each question directly and briefly. Then stop talking. Silence is the examiner's tool, not yours.

What to Say — and What Not to Say

This is where workers most often hurt themselves. A few simple rules:

Do

- Tell the truth. Unemployment fraud is a serious offense and the state cross-checks your answers against employer records, wages, and even bank deposits.

- Stick to facts and dates. "On April 12 my supervisor told me my position was eliminated effective April 26."

- Frame your separation in the state's language when it honestly fits. Workers who were laid off should say "laid off." Workers whose hours were cut to zero should say "hours were reduced to zero" or "my position was eliminated."

- Pause before answering when a question surprises you. It is fine to say, "Let me think for a second."

- Ask the examiner to repeat any question you do not understand.

- Have your timeline in front of you so dates come out right.

Don't

- Don't volunteer information that wasn't asked. If the examiner asks why you left, do not also explain that you were already job hunting before you quit. Answer the question and stop.

- Don't guess at dates. "I think it was sometime in March" can sink your claim. Look at your notes.

- Don't argue, swear, or insult your employer. Examiners are trained to discount emotional testimony. Stick to facts.

- Don't say "I quit" if you were forced out, constructively discharged, or laid off. The legal label of your separation matters. If the company eliminated your role, that is a layoff — not a quit, even if you signed a resignation letter under pressure.

- Don't admit to misconduct you did not commit just to keep the call short. Misconduct findings can disqualify you for the entire benefit year.

- Don't joke about side income, side hustles, or "under the table" work. Even joking comments are written into the examiner's notes.

What If You Miss the Call?

This happens more than you would think. Phones get blocked. Voicemails get filled. Notices get lost in spam folders. If you miss the interview:

- Call the state agency the same day the call was scheduled, if at all possible.

- Ask the agency to reschedule the interview and explain what happened.

- Get the name of the person you spoke with and write down the date and time.

- If you receive a denial because you missed the call, file an appeal immediately. Most states give you only 10 to 30 days to appeal.

A missed interview is one of the most common reasons claims get denied. It is also one of the most fixable — if you act fast.

After the Interview: How the Decision Is Made

You will not get a yes-or-no answer on the call. The examiner is gathering information, not making a ruling on the spot. Within a few days to a few weeks, you will receive a written determination in the mail or in your claimant portal. The determination will:

- State whether you are eligible or ineligible

- Explain the reason in writing

- Show the weekly benefit amount and maximum benefit amount if eligible

- Include appeal rights and a deadline if ineligible

Read the determination carefully. Even an "approved" determination can have hidden issues — a wrong base period, a misstated weekly benefit, or a non-monetary issue still pending.

If You Are Denied — Appeal Right Away

Most workers who win unemployment after an initial denial win it on appeal, not on the first phone interview. Appeals are scheduled as hearings, which are more formal than fact-finding interviews and are run by an administrative law judge or hearing officer. You can present evidence, call witnesses, and cross-examine your former employer.
